Welcome to GiGiLaBella. These terms explain the basis on which you may use our website and purchase from us. We have written them as clearly as possible so you know what to expect.
1. About us
GiGiLaBella is a trading brand of JR Phoenix Ltd, a company registered in England and Wales under company number 16240357. Our registered office is Suite A, 82 James Carter Road, Mildenhall, IP28 7DE, United Kingdom. You can contact us at hello@gigilabella.com.
Our online store is hosted by Shopify, which provides the ecommerce platform through which we offer our products.
2. Using our website
By visiting our website or placing an order, you agree to these terms together with our Privacy Policy, Shipping Policy and Return and Refund Policy. If you do not agree, please do not use the website.
You must be at least 18 years old, or use the website with the involvement and permission of a parent or legal guardian. You are responsible for providing accurate, current information and for keeping any account credentials secure.
3. Products and product information
We take care to present our products accurately. Colours and appearance may vary slightly because of photography, screen settings or normal production variation. Packaging may also be refreshed from time to time.
Ingredient information on the product page is provided for guidance. Formulations can be updated, so please always read the ingredient list and directions on the product you receive before use. If you have allergies, sensitivities, a skin condition, are pregnant, breastfeeding or under medical care, seek appropriate professional advice before use.
Our beauty and wellbeing content is general information only and is not medical advice. Patch test a new cosmetic where appropriate, follow the label directions and discontinue use if irritation occurs. Seek medical attention where necessary.
4. Prices, taxes and promotions
Prices are shown in the currency selected for your market and include applicable taxes where required. Delivery charges, if any, are shown before you complete checkout. International customers may also be responsible for local import duties or taxes where these are not collected at checkout.
We may change prices or promotions at any time, but this will not affect an order we have already accepted. Promotional offers may have separate terms and cannot be applied retrospectively unless stated otherwise.
5. Orders and acceptance
When you place an order, you are offering to buy the selected products under these terms. An order confirmation acknowledges receipt of your order; acceptance takes place when we confirm dispatch or otherwise confirm that the order has been accepted.
We may decline or cancel an order where a product is unavailable, information or pricing contains an obvious error, payment is not authorised, we reasonably suspect fraud or misuse, or delivery cannot be completed to the address provided. If we cancel after taking payment, we will issue a full refund for the affected item or order.
Please check your order and delivery details carefully. Contact us promptly if something needs correcting. Because orders enter preparation quickly, changes cannot always be guaranteed.
6. Payment
Available payment methods are shown at checkout. You confirm that you are authorised to use the selected payment method and that the billing information you provide is accurate. Payments may be processed by Shopify and other payment providers under their own terms and privacy notices.
7. Preparation, delivery and risk
Orders are prepared and delivered in accordance with our Shipping Policy. Delivery dates are estimates rather than guarantees unless we expressly agree otherwise. We remain responsible for the goods until they are delivered to you or to a person you nominate, except where you independently arrange your own carrier.
If a delay occurs, we will provide reasonable assistance and any rights available under applicable consumer law remain unaffected.
8. Cancellations, returns and refunds
Your cancellation, return and refund rights are explained in our Return and Refund Policy. In summary, eligible UK and EU consumer orders may be cancelled within 14 days after delivery. Sealed, unused products may be returned following our instructions; opened hygiene-sensitive cosmetics are excluded unless faulty, damaged or not as described. These terms do not limit your statutory rights.
9. Availability and website accuracy
We aim to keep availability, descriptions and other website information current, but occasional errors or interruptions can occur. We may correct errors and update or withdraw content where reasonably necessary. We do not guarantee that the website will always be uninterrupted, secure or free from technical faults.
10. Acceptable use
You may use the website only for lawful personal shopping and information. You must not misuse it, introduce harmful code, attempt unauthorised access, interfere with its operation, scrape or reproduce content at scale, submit false information, infringe another person's rights, or use the service for fraudulent or unlawful activity.
11. Intellectual property
The GiGiLaBella name, branding, product presentation, photography, text, graphics and website content are owned by or licensed to JR Phoenix Ltd and are protected by applicable intellectual-property laws. You may view and make limited copies for your personal, non-commercial use. No other use is permitted without our prior written consent.
12. Reviews and other content you submit
If you submit a review, image or other content, it must be truthful, lawful and based on your genuine experience. You retain ownership of your content but grant us a non-exclusive, worldwide, royalty-free licence to display, reproduce and adapt it for operating and promoting GiGiLaBella. We may moderate or remove content that is unlawful, misleading, abusive, infringing or unrelated.
13. Third-party links and services
Our website may contain links to services operated by third parties. We are not responsible for their independent content, availability or practices. Please review their terms and privacy information before using them.
14. Privacy
We handle personal information as described in our Privacy Policy. By using the website, you acknowledge that information needed to operate the store, process payment and fulfil orders may be handled by Shopify, payment providers, fulfilment partners and delivery carriers.
15. Our responsibility to you
We do not exclude or limit liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or your statutory consumer rights.
Where permitted by law, we are not responsible for losses that were not reasonably foreseeable when the contract was formed, losses caused by events beyond our reasonable control, or business losses arising from consumer use. Nothing in these terms requires you to give up rights that cannot lawfully be excluded.
16. Events beyond reasonable control
We are not responsible for delay or failure caused by circumstances beyond our reasonable control, such as severe weather, carrier disruption, industrial action, supply interruption, government action or failure of essential communications systems. We will take reasonable steps to minimise disruption and keep you informed where appropriate.
17. Changes to these terms
We may update these terms to reflect changes in our services, business or legal obligations. The version published when your order is accepted will apply to that order. The latest version will always be shown on this page.
18. General
If any provision is found unlawful or unenforceable, the remaining provisions will continue in effect. A delay in enforcing a right does not waive that right. These terms, together with the policies referred to in them, form the agreement between you and us for use of the website and purchases made through it.
19. Governing law
These terms are governed by the laws of England and Wales. Courts in England and Wales will have jurisdiction, except that consumers living elsewhere may retain any mandatory rights to bring proceedings in their home jurisdiction.
